Azzayna reserves the right to modify or adjust these general terms and conditions of sale at any time. In case of modification, the terms in effect at the time of the order will apply.

1: General Conditions: Acceptance and Application

The buyer acknowledges having read the General Terms and Conditions of Sale provided by Azzayna for its Azzayna.com website and accepts them without reservation at the time of the order. These general terms and conditions of sale take precedence over any other conditions unless prior written agreement. Azzayna is referred to below as the seller, operating through Azzayna.com, with its registered office at 6, rue des Ponts Saint Michel 41350 Saint Gervais la Forêt, FRANCE. Azzayna is registered with the Trade and Companies Register of Blois under the SIREN number 519 105 029. The buyer, defined below, is the company or person signing and accepting the sales conditions. The buyer declares to have the legal capacity to enter into the sale under the specified conditions, meaning being of legal age and not under guardianship or curatorship.

Any order placed on the site implies the consultation and unconditional acceptance of these General Terms and Conditions of Sale, without the need for a handwritten signature. In accordance with articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree No. 2001-272 of March 30, 2001, concerning electronic signatures, validation of the order form in article 2 constitutes an electronic signature equivalent to a handwritten signature in the eyes of the parties.

2 . Order

Automatic registration systems via the Internet are considered proof of the nature, content, and date of the order. In the case of an order via the Internet, Azzayna confirms the acceptance of the order to the customer by email to the provided address.

After reviewing the status of the order and providing all the required information, the buyer can confirm the order to make the payment. They will choose the preferred method of payment, provided that they have that means of payment.

The sale becomes final after Azzayna sends the order confirmation via Azzayna.com and upon receiving full payment. Azzayna recommends that the buyer keep this information in paper or electronic form. Azzayna reserves the right to cancel any order from a customer involved in a payment dispute for a previous order, partially or entirely unpaid.

3 . Prices

On our online store Azzayna.com, all prices are displayed in Euros and include value-added tax (VAT). The cost of delivery is the responsibility of the buyer if the invoice amount does not reach the threshold for free delivery.

Azzayna reserves the right to change its prices and services at any time. The products will be invoiced at the prices in effect on the Azzayna.com website at the time of order registration. The products remain the property of Azzayna until full payment of their price. All prices are in Euros, and transactions are conducted in Euros. The price indicated on the product page does not include shipping costs. The price shown in the order confirmation includes VAT, shipping, and packaging fees.

4 . Availability of Ordered Products

In the case of temporary unavailability, Azzayna will notify the buyer by email. The buyer will have one business week (excluding weekends and holidays) to request the cancellation or exchange of their order by contacting our customer service via this form: https://www.Azzayna.com/contact. Azzayna reserves an additional week to process the order. If a product is permanently unavailable after the order is placed, the buyer will be informed in the same manner via email or by phone about the items that are permanently out of stock. If no request from the buyer is received after this period, the order will be shipped with the available items, and only those items will be charged.

Products are offered subject to availability. In case of a product's unavailability, the buyer will be informed when viewing the product on the website. This information will be provided during the order process or after order confirmation, before delivery, preferably via email. Azzayna will then take the necessary measures with the Mollie payment interface to deduct the price of unavailable products from the buyer's bank account if payment was made by credit card, or with PayPal as applicable. In the case of payment by bank check, Azzayna will refund the excess amount by check.

5 . Delivery

Azzayna will ship the products to the address provided by the buyer during their order. If the buyer provides an incorrect or incomplete address, they will be held responsible for the inability to deliver the order. In the event of your package being returned due to an incorrect or incomplete address, the re-shipping costs will be your responsibility, regardless of the amount of your order, based on the prevailing rates in your country.

Any delivery delays do not entitle the buyer to request compensation. Upon receiving the delivery, the buyer is obligated to check the condition of the package and, if necessary, make reservations with the delivery person or refuse the delivery. Circumstances considered as force majeure, relieving Azzayna from its obligation to deliver, include war, riots, fires, strikes, accidents, and the impossibility of delivery.

The products are shipped at the recipient's own risk. It is imperative to always check your package upon arrival. If there is any doubt about the condition of the package upon receipt, it is your responsibility to refuse it. Otherwise, Azzayna will not be able to refund your package.

The delivery time between the customer's order and the receipt of the goods depends on the payment method chosen by the customer. Due to order preparation and product availability reasons (such as out-of-stock items or production stoppage), an order may be delivered in multiple shipments to the customer, who will only be charged for delivery fees once.

As an approximate reference, our service provider La Poste delivers throughout metropolitan France within 48 hours. Any potential delay in the delivery timeframe will not result in compensation, deductions, or order cancellations by the buyer.

In accordance with Article L. 121-20-3 of the Consumer Code, ordered products will be delivered within a maximum period of thirty days from the day following the order, subject to full payment of the price. If delivery is not made within this timeframe, the buyer may cancel their order. The amounts paid by the buyer will be promptly refunded without any additional compensation. In case of a delivery delay compared to the initially set date, the buyer should inform Azzayna in writing (via mail or email) to facilitate an investigation with the carrier and improve the quality of service.

Delivery times depend on the delivery address provided by the buyer. Azzayna does not cover customs duties applicable to orders delivered outside the European Union. The transportation fees indicated during the order do not include potential customs duties that may be charged upon delivery.

Free shipping applies only to orders destined for metropolitan France with a total amount equal to or exceeding €50 including VAT.

6 . Delivery Issue Related to the Carrier

Any discrepancy related to the delivery (missing products listed on the invoice, damaged package, broken products, loss, etc.) must be expressly noted on the delivery receipt as "handwritten reservations" and accompanied by the customer's signature. Additionally, the customer must confirm this discrepancy by sending, within two (2) business days following the delivery date, a registered letter with acknowledgment of receipt to the carrier, detailing their claims. All our shipments are carried out by La Poste, which provides delivery within 48 hours throughout France. This service also offers you the option to collect the ordered products at your nearest post office in case of absence at the initial delivery location when the mail carrier attempts delivery. If you are not present on the day of delivery, you will receive a delivery notification in your mailbox, allowing you to retrieve your package at your post office during its opening hours within a 15-day period. If your package is returned to us after this 15-day period, the re-shipping costs will be at your expense, regardless of the order amount, following the prevailing rate in your country.

Azzayna cannot be held responsible for delays and losses related to La Poste's service. However, the buyer should inform us of these incidents by sending us an email. At our request, La Poste will initiate an investigation lasting for 21 days within its services. Typically, within this timeframe, La Poste locates the lost package and delivers it to its recipient. If the product is not found within this timeframe, we will proceed with a new shipment, either of the same product or, with your prior consent, a similar product. Shipping costs will then be at our expense.

We disclaim any responsibility in case of delivery delays attributed to the carrier, especially in cases of product loss or strikes.

7 . Merchandise Return

We are committed to providing you complete satisfaction with all our products. In accordance with the regulations governing distance selling applicable to online sales, you have the right to return any item in its original condition to our address: Azzayna, 6 rue des Ponts Saint Michel, 41350 Saint Gervais la Forêt, within 14 days following the delivery date, and you will be fully reimbursed for the item's price via bank transfer or check.

However, this right of return does not apply to products returned damaged, incomplete, without the original packaging, or soiled by the customer. Additionally, this right does not apply if the customer fails to collect their package within the specified time frame at the pickup point, or if the prepaid return label is not used within the given time frame.

The packaging and re-shipping costs to Azzayna are the responsibility of the buyer, who must ensure that their packaging is sufficiently robust to ensure the receipt of the products in perfect condition at Azzayna's premises.

8 . Right of Withdrawal and Withdrawal Period

The customer has a withdrawal period of 14 clear days from the date of receiving their order to return the ordered products at their own expense for a refund. The products must be returned to the following address: Azzayna, 6 rue des Ponts Saint Michel, 41350 Saint Gervais la Forêt.

In case of exercising the right of withdrawal, Azzayna will refund the customer the corresponding amount within a maximum period of thirty (30) business days from the receipt of the return. Any customer placing an order is responsible for settling that order, even if they request the delivery to a different address.

10 . Accepted Payment Methods

By Credit Card

By Bank or Postal Check

In the case of payment by check, the customer must make the check payable to "Azzayna" and specify the order number on the back of the check. The check should then be sent by mail to the following address:

Only checks issued by a French bank are accepted. Azzayna will ship the products no earlier than five business days after the corresponding check for the order is cleared, subject to sufficient funds.

11 . Applicable Law and Dispute Resolution

In the event of a dispute, Azzayna commits to making every effort to find an amicable solution.

This contract is subject to French law, and in case of a dispute, the Commercial Court of Blois has sole jurisdiction. Azzayna cannot be held responsible for damages of any nature, whether they are material, immaterial, or bodily, resulting from a malfunction or misuse of the products sold.

The liability of Azzayna is in any case limited to the amount of the order and cannot be engaged for simple errors or omissions that may persist despite all precautions taken in the presentation of the products. Azzayna cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country, with its liability systematically limited to the value of the product in question as of the date of sale, without the possibility of recourse against the manufacturer of the product.
